You got divorced by mutual consent.
Settlement भी हो गया.
Then someone tells you:
“अब CAW Cell वाली FIR अपने आप खत्म हो जाएगी.”
Please don't assume that.
Look at the Delhi High Court order dated 17 July 2026 in Ajay Kumar Gupta & Ors. v. State of NCT of Delhi & Anr.
The FIR was No. 86/2024, registered at Crime (Women) Cell, Nanak Pura, under Sections 498A/406/34 IPC.
The husband and wife had mutually settled their disputes through a Memorandum of Understanding dated 8 April 2025.
Their marriage was subsequently dissolved by mutual consent under Section 13B(2) of the Hindu Marriage Act.
The wife appeared before the Delhi High Court and stated that she did not wish to continue the FIR.
The Court ultimately quashed FIR No. 86/2024 and all proceedings arising from it.
Now understand the practical point.
Divorce and FIR are two different things.
A decree dissolving a marriage does not, by itself, mean that every criminal proceeding connected with the matrimonial dispute has disappeared.
If you are a husband facing a CAW CELL DELHI complaint, you need to know exactly what happened to the criminal proceedings.
Was there only a CAW Cell complaint?
Was an FIR registered?
Was a chargesheet filed?
Was there an MoU?
Was the settlement actually acted upon?
Was the marriage dissolved?
Has the complainant given a statement before the appropriate court?
These details matter.
And this is where many Delhi NCR matrimonial disputes become unnecessarily complicated.
A husband may think:
“Divorce मिल गया, अब सब खत्म.”
But the police record may still show an FIR.
The court record may still show criminal proceedings.
And the settlement document may contain obligations that have to be properly completed.
In this particular case, the Delhi High Court had the benefit of a mutual settlement, the subsequent mutual-consent divorce and the complainant's statement that she did not wish to continue the FIR. On those facts, the Court found it appropriate to quash the proceedings.
So if you are dealing with CAW Cell Nanak Pura, CAW CELL DELHI, matrimonial FIR, 498A/406, settlement, mediation or divorce proceedings in Delhi & Delhi NCR, don't rely on one sentence:
“Settlement हो गया है.”
Ask for the complete procedural picture.
Complaint कहाँ है?
FIR कहाँ है?
Chargesheet हुई या नहीं?
Settlement में क्या लिखा है?
क्या compliance पूरा हुआ?
और criminal case formally खत्म कैसे होगा?
